Probation is the period of supervision over an offender imposed by a judge instead of serving time in prison. During the probation, the offender needs to comply with the terms and conditions set forth by the court. In many cases, this probationary period is overseen by a probation officer.

Common terms of probation are to abide to a curfew, to remain employed, to live at a directed place, not to leave the jurisdiction, and to refrain from possession of firearms. In domestic cases, the offender is usually ordered to refrain from contact with the victim(s). Additionally, offenders can be ordered to submit to repeated alcohol/drug testing or to participate in alcohol/drug or psychological treatment, or to perform community service work.

If the offender does not comply with the terms of his probation, his probation may be terminated and the offender has to serve the previously suspended time in prison instead. If brought before the court on a probation violation, offenders are entitled to representation by an attorney who may be able to introduce information or evidence to the court and bargain with the probation officer to help effectuate the offender’s wishes.
